Welcome to Olly. These Terms of Service ("Terms") govern your use of the Olly AI assistant service ("Service") operated by Obligation, Inc. ("we," "our," or "us"), a Delaware corporation. By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Olly, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using Olly, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

Olly is a personal AI assistant accessible via messaging platforms including SMS and iMessage. The Service provides features including but not limited to:

Answering questions with web-powered research
Analyzing and summarizing documents
Generating images
Setting reminders
General conversational assistance

4. User Responsibilities

You agree to:

Use the Service only for lawful purposes
Provide accurate information when required
Not attempt to circumvent any security features or access restrictions

The Service, including its design, features, and content (excluding user-submitted content), is owned by Obligation, Inc. and is protected by intellectual property laws. You retain ownership of content you submit to the Service, but grant us a license to use, process, and store that content as necessary to provide the Service.

7. Payment Terms

Olly offers both subscription plans and one-time purchases for premium features. By purchasing any paid features, you agree to:

Pay all applicable fees as described at the time of purchase
Provide accurate payment information
Authorize us to charge your payment method for recurring subscriptions until cancelled

Refunds: Refund requests are handled on a case-by-case basis at our sole discretion. To request a refund, please contact us at [email protected].

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period.

8. AI-Generated Content Disclaimer

Olly uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information. You should:

Not rely solely on Olly for critical decisions, especially regarding medical, legal, or financial matters
Verify important information from authoritative sources
Understand that AI responses do not constitute professional advice

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBLIGATION, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

YOUR USE OR INABILITY TO USE THE SERVICE
ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
ANY ERRORS OR OMISSIONS IN ANY CONTENT
ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Obligation, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Obligation, Inc. regarding your use of the Service and supersede any prior agreements.
